Welcome to AdaptLend. These Terms of Use ("Terms") govern your use of adaptlend.com (the "Site") and the matching service we provide. By using the Site or submitting our form, you agree to these Terms. If you don't agree, please don't use the Site.

1. Who we are — and who we are not

AdaptLend is a trade name (DBA) of Honest Casa LLC (NMLS #1566096, DRE #02022356). AdaptLend operates as a mortgage lead-matching service: we connect people whose situations don't fit conventional lending with independent, licensed mortgage brokers and loan originators ("Participating Professionals") who specialize in non-QM and non-conventional home loans.

AdaptLend is not a lender, not a mortgage broker, and not a loan originator. We do not make loans, take loan applications, quote rates, negotiate loan terms, or make credit decisions. Nothing on this Site is an offer to extend credit or a commitment to lend.

2. The matching service

When you complete our form, we use your answers to identify one or more Participating Professionals whose specialty fits your situation, and we share your submission with them so they can contact you. The description of a loan program on this Site (for example, "bank statement loan" or "DSCR loan") reflects how these programs commonly work; whether any program is available to you, and on what terms, is determined solely by the Participating Professional and their lenders based on your complete application.

3. Eligibility

The Site is intended for U.S. residents who are at least 18 years old and able to enter into a binding contract. By submitting the form, you confirm the information you provide is accurate, complete, and about yourself.

4. Consent to be contacted

Our form includes a consent checkbox. By checking it and submitting, you give your express written consent for AdaptLend and Participating Professionals to contact you about your inquiry at the phone number and email you provide — including by automated telephone dialing systems, prerecorded or artificial voice messages, text messages, and email — even if your number appears on a federal, state, or company do-not-call list. Consent is not a condition of receiving a loan or any service. Message and data rates may apply. You may revoke consent at any time by replying STOP to a text, following an email's unsubscribe instructions, or contacting us at the address below.

5. No financial, legal, or tax advice

Content on this Site is general information, not financial, legal, or tax advice. Talk to a licensed professional about your specific circumstances before making financial decisions.

6. Participating Professionals are independent

Participating Professionals are independent businesses, not our employees or agents. They are solely responsible for their own licensing, advice, loan programs, quotes, disclosures, and conduct. Your dealings with them — including any loan you obtain — are between you and them, and may be governed by their own terms and agreements. AdaptLend may receive compensation from Participating Professionals in connection with matches.

7. Acceptable use

You agree not to submit false information or information about another person without their authorization, interfere with the Site's operation, scrape or harvest data from the Site for commercial purposes, or use the Site for any unlawful purpose.

8. Intellectual property

The Site — including its text, design, graphics, and logos — belongs to AdaptLend or its licensors and is protected by intellectual-property laws. You may not reproduce or create derivative works from the Site except for your personal, non-commercial use.

9. Disclaimers

The Site and the matching service are provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that a match will be available for your situation, that any loan will be offered or closed, or that the Site will be uninterrupted or error-free.

10. Limitation of liability

To the fullest extent permitted by law, AdaptLend will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising out of your use of the Site or the matching service. To the extent any liability cannot be excluded, our total liability will not exceed one hundred U.S. dollars ($100).

11. Indemnification

You agree to indemnify and hold AdaptLend harmless from claims arising out of your breach of these Terms or your misuse of the Site.

12. Changes

We may update these Terms from time to time. The effective date above reflects the latest version, and continued use of the Site after changes means you accept them.

13. Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules, and any dispute will be brought in the state or federal courts located there.
